Compliance Update – I-9 Breaking News!

USCIS released the latest I-9 form (Form I-9, Employment Eligibility Verification) today, July 17, 2017. The changes are summarized below:

  • Name update: “Office of Special Counsel for Immigration-Related Unfair Employment Practices” changed to “Immigrant and Employee Rights Section”.
  • Deleted “the end of” from the phrase “the first day of employment.”
  • List C addition of “Consular Report of Birth Abroad (Form FS-240)”
  • Selection C#2 in List C now contains all certifications of report of birth issued by the Department of State List C documents renumbered (except the Social Security card).

Employers have 2 months to fully convert to using the new revision. Between now and September 17th Employer can use the revised version or continue using the I-9 form with a revision date of 11/14/16 N. On Sept. 18, employers must use the revised form with a revision date of 07/17/17 N. Employers must continue following existing storage and retention rules for any previously completed Form I-9.

As a reminder, the instructions must always be available for an employee to refer to when filling out an I-9 form. Instructions are also available in Spanish, however the Spanish I-9 form is not valid for use in the 50 states. There is a translator supplement available if more than one translator is used. The updates are included in the “Handbook for Employers: Guidance for Completing Form I-9 (M-274).”
